1988 NO. 158 CIVIL AVIATION REGULATIONS - REG 160

Interpretation
160. In this Division, an "overtaking aircraft" means an aircraft that
approaches another aircraft from the rear on a line forming an angle of less
than 70 degrees with the plane of symmetry of the latter, that isto say, an
aircraft that is in such a position with reference to another aircraft that at
night it would be unable to see either of the forward navigation lights of the
other aircraft.
