1994 No. 171 CUSTOMS (PROHIBITED IMPORTS) REGULATIONS (AMENDMENT) - REG 2

2. New regulation 4QD
2.1 After regulation 4QC, insert: Importation of goods originating in Haiti

"4QD. (1) Except in accordance with a permission granted under subregulation
(2), a person must not import goods:

   (a)  that originate in Haiti; and

   (b)  that have been exported from Haiti after the day on which this
        regulation commences.



"(2) The Minister for Foreign Affairs may grant a permission for the
importation of specified goods, or goods of a specified kind, if:

   (a)  the importation without the permission would contravene subregulation
        (1); and

   (b)  the Minister is satisfied that permitting the importation will not
        infringe Australia's international obligations.



"(3) A permission may specify, in relation to the importation of goods:

   (a)  conditions or requirements, including times for compliance, to which
        the importation is subject; and

   (b)  the quantity of the goods that may be imported; and

   (c)  the circumstances in which the goods may be imported.



"(4) The Minister for Foreign Affairs may revoke or modify a permission if he
or she is satisfied, on reasonable grounds, that:

   (a)  a condition or requirement of the permission has not been complied
        with; or

   (b)  permitting, or continuing to permit, the importation of the goods in
        accordance with the permission would infringe Australia's
        international obligations.



"(5) A power of the Minister for Foreign Affairs under subregulation (2), (3)
or (4) may be exercised by a person authorised in writing by the Minister for
Foreign Affairs to exercise the power.



"(6) If a person authorised under subregulation (5) forms the opinion that a
permission should not be granted, the person must refer the application for
the permission to the Minister for Foreign Affairs.



"(7) The Minister for Foreign Affairs must decide an application referred to
in subregulation (6).".
