DIESEL AND ALTERNATIVE FUELS GRANTS SCHEME AMENDMENT REGULATIONS 2001 (NO. 1) 2001 NO. 17 - SCHEDULE 1

7 Applicable amounts — diesel and alternative fuels (Act s 11)
(1) For paragraph 11 (1) (b) of the Act, the amount per litre (or per cubic metre) that is applicable to a type of fuel is:
(a) in relation to a grant period ending before 1 February 2001:

(i)
for diesel — 17.798 cents per litre;
(ii)
for liquefied petroleum gas — 11.466 cents per litre;
(iii)
for ethanol — 20.009 cents per litre;
(iv)
for compressed natural gas — 12.132 cents per cubic metre; and

(b) in relation to a grant period ending on or after 1 February 2001 — the amount specified in subparagraph (a) (i), (ii), (iii) or (iv), as the case requires, adjusted in accordance with the indexation scheme set out in regulation 7A.

(2)
An amount that is applicable to a fuel specified in subregulation (1) does not apply to a blend of that fuel and another fuel, whether or not the other fuel is specified in that subregulation.

7A Indexation of amounts (grant periods ending on or after 1 February 2001)
(1) In this regulation, unless the contrary intention appears:

"indexation period" means the 6-month period starting on 1 February 2001 and each subsequent 6-month period.

"index number", in relation to a quarter, means the All Groups Consumer Price Index number, being the weighted average of the 8 capital cities, published by the Australian Statistician in respect of that quarter.

"relevant applicable amount", in relation to a type of fuel and an indexation period, means the amount that is to be applicable to that type of fuel for that indexation period under paragraph 7 (1) (b).

"relevant base amount", in relation to a type of fuel and an indexation period, means the amount that, in accordance with paragraph 7 (1) (a) or (b), was applicable to that type of fuel immediately before the commencement of that indexation period.

(2) If the factor ascertained in relation to an indexation period in accordance with subregulation (3) is more than 1, the relevant applicable amount in relation to a type of fuel for that period is:

(a)
the amount, calculated to 3 decimal places, that is equal to the relevant base amount multiplied by that factor; or

(b)
if that amount, when calculated to 4 decimal places, ends in a number greater than 4, that amount increased by 0.001.

(3) Subject to subregulations (4) and (5), the factor to be ascertained for the purposes of subregulation (2) in relation to an indexation period is:
(a) the number, calculated to 3 decimal places, ascertained by dividing:

(i)
if the indexation period commences on 1 February — the index number for the last preceding December quarter; or
(ii)
if the indexation period commences on 1 August — the index number for the last preceding June quarter;
by the highest index number in respect of a December or June quarter that preceded that quarter, not being a December or June quarter

that occurred before the June quarter in the year 2000; or

(b)
if the number so ascertained, when calculated to 4 decimal places, ends in a number greater than 4, the number so ascertained increased by 0.001.

Subject to subregulation (5), if at any time, whether before or after the commencement of this regulation, the Australian Statistician has published or publishes an index number in respect of a quarter in substitution for an index number previously published by the Australian Statistician in respect of that quarter, the publication of the later index number shall be disregarded for the purposes of this regulation.

(5)
If at any time, whether before or after the commencement of this regulation, the Australian Statistician has changed or changes the reference base for the consumer price index, then, for the purposes of the application of this regulation after the occurrence of the change, regard shall be had only to index numbers published in terms of the new reference base.

(6)
The Commissioner must, as soon as practicable after the commencement of an indexation period, publish for the information of the public a notice in the Gazette setting out the amount applicable under regulation 7 to each type of fuel for that indexation period.
