DEFENCE REGULATION 2016 (F2016L01568) - REG 64

Offence of obstructing or hindering

             (1)  A person commits an offence if:

                     (a)  the person obstructs or hinders another person; and

                     (b)  the other person is:

                              (i)  a member of the Defence Force; or

                             (ii)  a police officer; or

                            (iii)  an Australian Government officer; or

                            (iv)  a person authorised by the Minister for section 63; and

                     (c)  the other person is exercising a power under section 63 to remove a person or item of movable property.

Penalty:  20 penalty units.

             (2)  A person commits an offence if:

                     (a)  the person obstructs or hinders another person; and

                     (b)  the other person is acting under a direction given under section 63.

Penalty:  20 penalty units.
