Note 1    For the definitions of establishment , fish , fish product , preparation and prescribed commodity , see the Export Inspection and Meat Charges Collection Act 1985 .

Note 2    For registration of fish products establishments, see the Export Control (Fish and Fish Products) Orders 2005 .

Note 3    For other provisions relating to establishment registration charges (including when charge is due for payment), see the Export Inspection and Meat Charges Collection Regulations 1985 .

         (2)   For section 6 of the Act, for the registration of an establishment for operations associated with the preparation of fish or fish products, the charges are to be imposed in respect of the following periods:

5               Exemption from charge

                For subsection 6 (2) of the Act, a marine laboratory is exempt from charge if:

                (a)    it is operated or funded by the Commonwealth or a State or Territory; and

               (b)    its primary function is to research and develop export markets without engaging in commercial trade.

6               Rates of charge -- fish products establishments

         (1)   For section 7 of the Act, the rate of charge for the registration of a fish products establishment for a year is the rate mentioned in Schedule 1 that applies to the establishment.

         (2)   If 2 or more items in Schedule 1 apply to a fish products establishment, the rate of charge that applies to the establishment is the higher or highest of the rates mentioned for the items.
