1985 No. 55 EXTRADITION (HIJACKING OF AIRCRAFT) REGULATIONS (AMENDMENT) - REG 2

2. Regulation 2 of the Principal Regulations is repealed and the following
regulations are substituted: Interpretation

"2. In these Regulations-
'Convention' means the Convention for the Supression of Unlawful Seizure of
Aircraft (being the Convention referred to in the Crimes (Hijacking of
Aircraft) Act 1972);
'the Act' means the Extradition (Foreign States) Act 1966.

Application of Act

"3. (1) Notwithstanding any limitations, conditions, exceptions, or
qualifications to which the application of the Act in relation to a foreign
state specified in Part I of the Schedule is subject by reason of sub-section
9 (2) or 11 (2) of the Act, the Act applies in relation to each of those
foreign states subject to the Convention.

"(2) Notwithstanding any limitations, conditions, exceptions or qualifications
to which the application of the Act in relation to each foreign state
specified in Part II of the Schedule is subject by reason of sub-section 11
(2) of the Act, the Act applies in relation to each of those foreign states
subject to-

   (a)  the Convention; and

   (b)  the condition that offences against a law of, or of a part of, that
        state that are offences of the kind referred to in sub-section 4 (5)
        of the Act are extradition crimes for the purposes of the Act.



"(3) The Act applies in relation to each foreign state specified in Part III
of the Schedule subject to-

   (a)  the Convention; and

   (b)  the condition that the only offences against a law of, or of a part
        of, that state that are extradition crimes for the purposes of the Act
        are offences of the kind referred to in sub-section 4 (5) of the
        Act.".
