ENVIRONMENT PROTECTION AND BIODIVERSITY CONSERVATION REGULATIONS 2000 2000 NO. 181 - REG 14.01

Ranger may ask for person's name and address
(1)
For section 400 of the Act, a ranger or an authorised officer may ask a person to tell the ranger or authorised officer the person's name and address if the ranger or authorised officer finds the person committing, or there are reasonable grounds for suspecting that the person has committed, an offence against the Act or these Regulations.

(2)
For section 400 of the Act, a ranger or an authorised officer may:

(a)
ask a person to show the ranger or authorised officer any authority, licence or permit issued to the person under the Act or these Regulations; or

(b)
ask a person to show the ranger or authorised officer any permit, licence or authority needed for an activity the ranger or authorised officer suspects on reasonable grounds the person has carried on.

(3)
A person must comply with a request under subregulation (1) or (2).

Penalty:
10 penalty units.

(4)
However, a person must comply with the request only if the ranger or authorised officer who makes the request produces his or her identity card for inspection by that person.

(5)
A person must not knowingly give or produce false or misleading information or documents to a ranger or an authorised officer, who makes a request under subregulation (1) or (2).

Penalty:
10 penalty units.
