ENVIRONMENT PROTECTION AND BIODIVERSITY CONSERVATION REGULATIONS 2000 2000 NO. 181 - REG 17.10

Authorities under permits
(1)
A holder of a permit to which paragraph 17.01 (b) or (c) applies may authorise a person to take an action under the permit.

(2)
An authority may be given only if:

(a)
it is in writing; and

(b)
the permit has a condition that allows a holder of the permit to give an authority; and

(c)
it is given in accordance with the condition; and

(d)
for a permit to which paragraph 17.01 (c) applies — paragraphs 17.03 (2) (b), (c) and (d) will continue to be satisfied if the authority is given.

(3)
A permit is taken to allow an action that is taken by an authorised person in accordance with an authority.

(4)
A holder of a permit may also take an action for which the holder has authorised another person.

(5)
A person who gives an authority under this regulation must, within 14 days after giving the authority, give written notice of it to:

(a)
for a permit issued by the Minister — the Minister; or

(b)
for a permit issued by the Director — the Director.

Penalty:
20 penalty units.
