(1) For paragraph 3.07 (2) (a), the arrangements must ensure that, for an
overseas student who has paid course money to a member of the scheme for a
course, subregulation (2) is satisfied if:
- (a)
- the course does not start on
the agreed starting day of the course and the student has not withdrawn before
that day; or
- (b)
- the member ceases to provide the course after it starts but before it is
completed and the student has not withdrawn before the day when the member
ceased to provide the course; or
- (c)
- the member does not provide the course in full to the student because a
sanction has been imposed on the member under Part 6 of the Act and the
student has not withdrawn before the day when the sanction was imposed.
(2) For subregulation (1), the student:
- (a)
- must be provided with a suitable
alternative course to the course that the member has not started to provide,
has ceased to provide or does not provide in full; and
- (b)
- must not be required to pay any additional amount to undertake a part of
the alternative course for which course money has been paid to the member.
