Nothing in this Part is to be taken:
- (a)
- to require that a provider
suspected of having contravened subsection 104 (1) or section 105 of the
Act be served an infringement notice; or
(b) to affect the liability of a provider to be prosecuted for an alleged
offence, if:
- (i)
- an infringement notice is not served on the provider for
the offence; or
- (ii)
- an infringement notice is served, and withdrawn; or
- (c)
- to limit the penalty that may be imposed by a court on a provider
convicted of an offence.
