EDUCATION SERVICES FOR OVERSEAS STUDENTS REGULATIONS 2001 2001 No. 96 - REG 9.02
Tuition assurance schemes approved under old Regulations
- (1)
- This regulation applies to a tuition assurance scheme that was approved
under regulation 17 of the old Regulations (unless the approval has been
revoked).
- (2)
- The operator of the scheme is taken to have applied for
approval of the scheme under regulation 3.06.
- (3)
- The scheme is taken, for subsection 22 (1) of the Act, to be a
tuition assurance scheme established in accordance with these Regulations.
- (4)
- Subregulation (3) ceases to apply:
- (a)
- when the Minister approves the
scheme under regulation 3.07; or
- (b)
- if the Minister refuses to approve the scheme:
- (i)
- unless subparagraph (ii) applies, at the end of the time within which an
application for review of the Minister's decision can be made; or
- (ii)
- if an application for review is made, when the review decision has
effect.
- (5)
- In this regulation:
"old Regulations" means the Education Services for Overseas Students
(Registration of Providers and Financial Regulation) Regulations.
