FEDERAL CIRCUIT AND FAMILY COURT OF AUSTRALIA (FAMILY LAW) RULES 2021 (F2021L01197) - RULE 8.19
Use of affidavit without cross-examination of maker
The court may:
(a) dispense with the attendance for cross-examination of a deponent of
an affidavit; or
(b) direct that an affidavit be used without the deponent being
cross-examined on the affidavit.
