FINANCIAL FRAMEWORK (SUPPLEMENTARY POWERS) AMENDMENT (HEALTH MEASURES NO. 5) REGULATIONS 2018 (F2018L01719) - SCHEDULE 1

   

Financial Framework (Supplementary Powers) Regulations 1997

1  Part 4 of Schedule 1AB (table item 179, column headed "Objective(s)", after paragraph (a) (first occurring))

Insert:

(aa) developing or revising a tool that may be used:

(i) to diagnose Fetal Alcohol Spectrum Disorder ( FASD ); or

(ii) to assess the impairment caused by FASD; and

2  Part 4 of Schedule 1AB (table item 179, column headed "Objective(s)", after paragraph (f))

Insert:

(fa) developing and disseminating resources for teachers and support staff who work in schools or early childhood services that will assist them:

(i) to identify whether a child may have FASD; or

(ii) to maximise the academic and social development of a child with FASD; and

(fb) developing and disseminating resources that promote employment opportunities for people with FASD by providing guidance on how to assist people with FASD to find, obtain and maintain employment, including by combatting stereotypes and prejudices that relate to people with FASD; and

3  Part 4 of Schedule 1AB (table item 179, column headed "Objective(s)", paragraph (a) (second occurring))

Repeal the paragraph, substitute:

(a) measures in connection with communications; or

(aa) the collection, analysis, dissemination or use of statistics; or

(ab) providing assistance to aliens or immigrants; or

4  Part 4 of Schedule 1AB (table item 179, column headed "Objective(s)", subparagraph (d)(v))

Omit "25 and 26", substitute "24, 25, 26 and 27".

5  Part 4 of Schedule 1AB (table item 179, at the end of the column headed "Objective(s)")

Add:

; or (g) measures carried out in, or in relation to, a Territory.

6  In the appropriate position in Part 4 of Schedule 1AB (table)

Specialist Dementia Care Program

To provide grants to organisations and the States and Territories to deliver care and services or other support to eligible care recipients, including specialist care for people exhibiting very severe behavioural and psychological symptoms of dementia.

This objective also has the effect it would have if it were limited to measures:

(a) to provide, or incidental to the provision of, sickness benefits; or

(b) to meet Australia's obligations under:

(i) the Convention on the Rights of Persons with Disabilities, particularly Articles 4, 25, 26 and 28; or

(ii) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; or

(c) involving the granting of financial assistance to a State or Territory; or

(d) undertaken in, or in relation to, a Territory.

beyondblue National Depression and Anxiety Initiative

To fund Beyond Blue Limited to reduce the impact of depression, anxiety and related disorders in Australia, including by:

(a) implementing measures to increase awareness of, and reduce stigma associated with, depression, anxiety and related disorders; and

(b) implementing measures to enhance the capacity of individuals and communities to respond to depression, anxiety and related disorders, including by the following:

(i) developing and delivering tools, resources, information and workplace mental health programs;

(ii) providing advice and support services;

(iii) encouraging people to seek support and to access primary mental health care;

(iv) entering into and promoting partnerships with other entities (including businesses, the community sector and the media);

(v) providing advice and support to other entities that are conducting public awareness raising campaigns or initiatives which encourage people to seek treatment for depression, anxiety and related disorders; and

(c) developing and delivering training and support for professionals providing services to people experiencing depression, anxiety and related disorders; and

(d) commissioning research into, and disseminating knowledge of, the causes of, and treatments for, depression, anxiety and related disorders; and

(e) undertaking research and providing advice to the Commonwealth in relation to depression, anxiety and related disorders; and

(f) conducting trials of ways of preventing, detecting, treating and managing depression, anxiety and related disorders; and

(g) commissioning an independent evaluation of Commonwealth funded activities conducted by Beyond Blue Limited.

This objective also has the effect it would have if it were limited to:

(a) supporting activities in connection with telephonic or electronic communications; or

(b) collecting data and otherwise conducting research for the purpose of informing the Commonwealth; or

(c) giving effect to Australia's obligations under:

(i) the Convention on the Rights of Persons with Disabilities, particularly Articles 4, 5, 8 and 25; or

(ii) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12.
