1984 No. 425 FAMILY LAW RULES - ORDER 15 RULE 16

Affidavits filed after return day
16. (1) After the return day of an application a party shall not, without the
leave of the court or a Registrar or the consent of all other parties to the
proceedings, file in those proceedings an affidavit other than-

   (a)  if the party is an applicant-one affidavit in support of the
        application;

   (b)  if the party is a respondent-one affidavit in answer to the
        application and in support of any cross-application;

   (c)  if the party is an applicant-one affidavit in reply and in answer to
        any cross-application;

   (d)  one affidavit by each witness; and

   (e)  one additional affidavit sworn by the party and filed not less than 7
        days before the commencement of the hearing of the application.

(2) This rule does not apply to-

   (a)  an affidavit in relation to an application filed after the return day
        seeking interim or interlocutory orders; or

   (b)  an affidavit otherwise required by the Act, the Regulations or these
        Rules to be filed.
