1984 No. 425 FAMILY LAW RULES - ORDER 23 RULE 12

Application for appointment of next friend
12. (1) Where an application has been served on a person under disability in
accordance with these Rules and that person does not, before the return day of
the proceedings, file a pleading, affidavit or notice of address for service
in the proceedings, any other person, including another party to the
proceedings, may apply to the court for the appointment of a next friend of
the person under disability.

(2) A corporation authorized under the law of a State or Territory to be
appointed to act as a guardian ad litem of a person under disability may apply
to the court to be appointed as next friend of the person under disability in
the proceedings.

(3) An application under this rule may be made ex parte.
