1988 No. 272 FISHERIES LEVY REGULATIONS - REG 3
Prescribed licences
3. (1) The following class of fisheries licences is prescribed for the
purposes of paragraph 5 (a) of the Act, namely, a licence (in this
subregulation called "the first licence") granted under subsection 9 (2) or
(3) of the Fisheries Act 1952 in respect of an Australian boat, other than:
(a) a boat in respect of which a licence is in force under subsection 9
(3) or (2) of that Act, as the case may be, being a licence in respect
of which levy has been paid; or
(b) a boat in respect of which a licence under subsection 9 (3) or (2) of
that Act, as the case may be, is granted, being a licence that is
granted at the same time as the first licence, where levy is paid in
respect of the first licence.
(2) The following class of fisheries licences is prescribed for the purposes
of paragraph 5 (ba) of the Act, namely, a licence renewed (in this
subregulation called "the first renewal") under subsection 9 (6B) of the
Fisheries Act 1952 in respect of an Australian boat, other than:
(a) a boat in respect of which a licence is in force, being a licence in
respect of which levy has been paid; or
(b) a boat in respect of which a licence is being renewed, being a renewal
that takes place at the same time as the first renewal, where levy is
paid in respect of the first renewal.
