FAMILY LAW RULES 20042003 No. 375 - RULE 12.12

Request to attend by electronic communication
(1)
A party may request permission to attend a court event by electronic communication.

Note
Subrule 5.06 (4) sets out the matters the court may take into account when considering a request under subrule (1).

(2)
A request must:

(a)
be in writing;

(b)
be made at least 7 days before the date fixed for the procedural hearing or conference;

(c)
set out the reasons why the court should grant permission;

(d)
set out whether any child representative and any other party agrees to the party attending by electronic communication; and

(e)
be served on each other party.

(3) If the court grants the request, the court may:

(a)
order a party to pay the expense of the attendance; or

(b)
apportion the expense between the parties.

(4)
A party who is in prison must attend at a procedural hearing or conference by electronic communication.
