FAMILY LAW RULES 20042003 No. 375 - RULE 15.18

Subpoena not to issue in certain circumstances

The court must not issue a subpoena:

(a)
at the request of a self-represented party, unless the party has first obtained the Registrar's permission to make the request; or

(b)
for production of a document in the custody of the court or another court.

Note 1
Rule 15.34 sets out the procedure to be followed when a party seeks to produce to the court a document from another court.
Note 2
A prisoner required to give evidence at a hearing must do so by electronic communication, if practicable. Otherwise the party requiring the prisoner's attendance must seek an order for the prisoner's personal attendance (see rule 5.07).
