FAMILY LAW RULES 20042003 No. 375 - RULE 15.38
Appointing an assessor
- (1)
- A party may apply for the appointment of an assessor by filing an
Application in a Case (Form 2) and an affidavit.
(2) The affidavit must:
- (a)
- state:
- (i)
- the name of the proposed assessor;
- (ii)
- the issue about which the assessor's assistance will be sought; and
- (iii)
- the assessor's qualifications, skill and experience to give the
assistance; and
- (b)
- attach the written consent of the proposed assessor.
- (3)
- The court may appoint an assessor on its own initiative only if the court
has:
- (a)
- notified the parties of the matters mentioned in subrule (2);
and
- (b)
- given the parties a reasonable opportunity to be heard in relation to the
appointment.
