FAMILY LAW RULES 20042003 No. 375 - RULE 18.03

Property value exceeding limit — power to determine case

If, in a case:

(a)
a Judicial Registrar exercises the power of the court mentioned in paragraph 18.02 (1) (c); and

(b) it becomes apparent during the trial that the gross value of the property to be dealt with in the case exceeds $2 000 000;

the Judicial Registrar may continue to hear and determine the case.

Note
Under section 90MC of the Act, a superannuation interest is to be treated as property for the purposes of paragraph (ca) of the definition of matrimonial cause in section 4 of the Act.
