FAMILY LAW RULES 20042003 No. 375 - RULE 20.25

Notice of claim
(1)
If an enforcement officer seizes, or intends to seize, property under an Enforcement Warrant, an affected person may serve a notice of claim on the enforcement officer.

(2)
A notice of claim must:

(a)
be in writing;

(b)
state the name and address of the affected person;

(c)
identify each item of property that is the subject of the claim; and

(d)
state the grounds of the claim.

(3)
The enforcement officer must serve a copy of the notice of claim on the payee.

(4)
The Enforcement Warrant must not be executed until at least 7 days after the notice of claim was served on the payee.
