FAMILY LAW RULES 20042003 No. 375 - RULE 21.09

Duties of program provider

(1) If a person is ordered, under section 70NG of the Act, to attend a program, the program provider must give the court notice:

(a)
if the order is made under subparagraph 70NG (1) (a) (i) of the Act — if the person:

(i)
fails to attend the provider for the initial assessment; or
(ii)
is considered unsuitable to attend a program; or

(b) if the order is made under subparagraph 70NG (1) (a) (ii) of the Act:

(i)
if the person fails to attend the program, or part of the program; or
(ii)
the program provider considers that the person is unsuitable to continue attending all or part of the program.
(2)
The notice must:

(a)
be in writing and addressed to the Registry Manager of the filing registry; and

(b)
comply with subrule 24.01 (1).
