- (1)
- A party who is in prison must attend at a settlement conference,
procedural hearing or the hearing of an appeal by electronic communication, if
practicable.
- (2)
- A party may seek permission from the court to attend an
appeal in person.
Example
A party may apply for an order under
subrule (2) if a prison or court has no facilities for the appeal to
proceed by electronic communication.
- (3)
- A request under subrule (2) must:
- (a)
- be in writing;
- (b)
- be made at least 28 days before the date fixed for the appeal;
- (c)
- set out the reasons why permission should be granted; and
- (d)
- set out the notice given of the request to any other party and whether
there is any objection to the request.
