FAMILY LAW RULES 20042003 No. 375 - RULE 22.48

Orders about conduct of application

In considering an application for permission to appeal from an order, a Judge may make procedural orders, including an order:

(a)
requiring the appellant to file a written undertaking to pay any filing fee; or

(b)
that the proposed appeal be argued at the same time as the application for leave to appeal.

Note
An application for permission to appeal from an order of another court may be listed for hearing at the same time as the hearing of the appeal. Alternatively, the application may be dealt with before the hearing and if the court gives an applicant permission to appeal, the appeal process commences.
