FAMILY LAW RULES 20042003 No. 375 - RULE 3.08
Attendance at hearing
- (1)
- A party may apply under rule 5.06 to attend the hearing of an Application
for Divorce (Form 3) by electronic communication.
(2) Subject to Part
3.4:
- (a)
- if the applicant fails to attend the hearing in person or by a
lawyer, the application may be dismissed; and
- (b)
- if the respondent fails to attend the hearing in person or by a lawyer,
the applicant may proceed with the hearing as if the application were
undefended.
