FAMILY LAW RULES 20042003 No. 375 - RULE 3.10

Hearing in absence of parties — joint application
If, in a joint Application for Divorce (Form 3), the applicants request that the case be heard in their absence, the court may so determine the case.

Note
The court must not determine the Application in the absence of the parties if there are any children of the marriage who are under 18 and the court is not satisfied that proper arrangements have been made for their care, welfare and development (see subsection 98A (2A) of the Act).
