FAMILY LAW RULES 20042003 No. 375 - RULE 7.20

Proof of service in non-convention country

(1) This rule applies if:

(a)
a document is sent to the Secretary of the Attorney-General's Department for service on a person in a non-convention country; and

(b)
an official certificate or declaration by the government or court of the country, stating that the document has been personally served, or served in another way under the law of the country, is sent to the court.

(2)
The certificate or declaration is proof of service of the document and, when filed, is a record of the service and has effect as if it were an affidavit of service.

Note
If service cannot be carried out under this rule, the applicant may apply for an order dispensing with service (see rule 7.18).


Summary of Chapter 8
Chapter 8 sets out rules about:
* the people who may be heard by the court and the requirements for their address for service;
* the appointment of a child representative; and
* lawyer's conflict of interest and ceasing to act.
The rules in Chapter 1 relating to the court's general powers apply in all cases and override all other provisions in these Rules.
