FEDERAL MAGISTRATES COURT RULES 2001 2001 No. 195- RULE 43.02
Stay
- (1)
- An application under section 44A of the Administrative Appeals Tribunal
Act for an order staying or otherwise affecting the operation or
implementation of a decision subject to appeal must be made in accordance with
the form of application set out in Part 1 of Schedule 2.
- (2)
- The
application may be made returnable on the date fixed for the first court date
or any other date fixed by a Registrar.
- (3)
- The application may in an urgent case be made in the absence of a party.
