5.1 Omit the regulation, substitute: Fees

"21. (1) There is payable, in relation to a matter referred to in column 2 of
an item in Schedule 2, the fee set out in column 3 of that item.

"(2) In spite of subregulation (1) and item 9 of Schedule 2, no fee is payable
on the variation of a condition of a fishing permit if:

   (a)  the permit is a fishing permit for the South East Trawl Fishery; and

   (b)  the variation is to take account of the transfer:

        (i)    to that permit - of quota of a scheduled species of fish
               granted to the holder of another permit of that kind; or

        (ii)   from that permit - of quota of a scheduled species of fish
               granted to the holder of another permit of that kind.".
