5. Regulation 4 does not apply in relation to-

   (a)  a request for, or the provision of, access to a document to which
        regulation 6 or 7 applies; or

   (b)  a request for access to a document where-

        (i)    a decision is made not to grant the request; and

        (ii)   regulation 7 would, if the request had been granted, have
               applied to the document.
