1992 No. 17 FISHERIES RESEARCH AND DEVELOPMENT CORPORATIONS REGULATIONS (AMENDMENT) - REG 5

  5.1   After regulation 4, insert:
Levies attached to the Corporation

"4A. (1) For the purposes of paragraph 5 (1) (a) of the Act, the following
levies are attached to the Corporation:

   (a)  the levy imposed by section 5 of the Fisheries Levy Act 1984;

   (b)  the levy imposed by section 5 of the Fishing Levy Act 1991;

   (c)  the levy imposed by section 4 of the
        Foreign Fishing Licences Levy Act  1991 .

"(2) For the purposes of paragraph 5 (1) (a) of the Act, the following classes
of levies are attached to the Corporation:

   (a)  payments under section 5 of the Fisheries Agreement (Payments) Act
        1991;

   (b)  payments under section 6 of the Fisheries Agreements (Payments) Act 
        1991 .

"(3) For the purposes of paragraph 5 (3) (a) of the Act the following
proportions are specified as the research component of the levies referred to
in paragraphs 4A (1) (a), (b), and (c) respectively:

   (a)  7.09%;

   (b)  12.82%;

   (c)  0.51%.

"(4) For the purposes of paragraph 5 (3) (a) of the Act the following
proportions are specified as the research component of payments included in
the classes of levies referred to in paragraphs 4A (2) (a), and (b)
respectively:

   (a)  3.03%

   (b)  3.03%.

"(5) For the purposes of paragraph 5 (3) (b) of the Act, the fishing industry
is the primary industry to which:

   (a)  the levies referred to in subregulation (1) relate; and

   (b)  payments included in the classes of levies referred to subregulation
        (2) relate.". Gross value of production of fishing industry

"4B. (1) For the purposes of subsection 30A (5) of the Act, the Minister is to
determine the total GVP for a financial year in accordance with the formula:

A is the sum of the gross value of production of the goods that are the
produce of that part of the fishing industry concerned with taking or
culturing fish or fish products, whether managed by or on behalf of the
Commonwealth, a State or a Territory for the 3 immediately preceding financial
years.

"(2) A reference to the gross value of production in A is a reference to the
gross value of production as shown by figures supplied by the Department of
Primary Industries and Energy.". Gross value of production of Commonwealth
managed fisheries

"4C. (1) For the purposes of subsection 30A (5) of the Act, the Minister is to
determine the Commonwealth GVP for a financial year in accordance with the
formula:

B is the sum of the gross value of production of the goods that are the
produce of that part of the fishing industry concerned with taking or
culturing fish or fish products managed by or on behalf of the Commonwealth
for the 3 immediately preceding financial years.

"(2) A reference to the gross value of production in B is a reference to the
gross value of production as shown by figures supplied by the Department of
Primary Industries and Energy.".
