HAZARDOUS WASTE (REGULATION OF EXPORTS AND IMPORTS) (WAIGANI CONVENTION) REGULATIONS 1999 1999 No. 7 - REG 15
15 Condition of permit Ñ notification of accidents
It is a condition of a Waigani import permit or a Waigani transit permit that
if an accident occurs during a transboundary movement of hazardous waste under
the permit, and the accident is likely to present a risk to human health or
the environment, the holder of the permit immediately informs:
(a) the Department of the Environment; and
(b) the Competent Authority of any affected Party (other than Australia);
and
(c) the appropriate authority of any other affected country. Note The
Department of the Environment administers the Act at present. If the
Department's name is changed, or it is abolished, or another
Department takes over the administration of the Act, paragraph 15 (a)
will have effect as if the name of the new Department were
substituted, if the Governor-General so orders Ñ see the
Acts Interpretation Act 1901 , ss 19B (2), 19BA (2) and 46 (1) (a).
