1989 No. 12 INDUSTRIAL RELATIONS REGULATIONS - REG 106
Application of Division with respect to organisations divided into branches
106. (1) Where an organisation is divided into branches:
(a) this Division (other than this regulation and regulation 115) applies
in relation to the organisation as if the financial affairs (including
transactions) of a branch did not form part of those of the
organisation; and
(b) this Division (other than this regulation and regulation 115) applies
in relation to each of the branches as if the branch were itself an
organisation.
(2) For the purposes of the application of this Division, in accordance with
paragraph (1) (b), in relation to a branch of an organisation:
(a) the members of the organisation constituting the branch shall be
deemed to be members of the branch; and
(b) any employees of the organisation employed in connection with the
branch (whether or not they are also employed in connection with any
other branch or branches) shall be deemed to be employees of the
branch.
(3) Subregulations (1) and (2) do not apply in relation to an organisation in
relation to which a certificate issued by a Registrar under subsection 271 (3)
of the Act is in force.
