23. (1) Subject to subregulation (2), the Tribunal is to review an IRT
reviewable decision if an application for review of the decision is made in
accordance with these Regulations.

(2) In the case of a decision to refuse to grant a Class 812 (December 1989
(permanent)) entry permit, subregulation (1) applies only if the applicant for
the permit:

   (a)  was a prohibited non-citizen on or before 18 December 1989; and

   (b)  had not been taken into custody under section 92 or 93 of the Act
        before lodgment of the application for the permit.
