  37.1   Clause 120.211:
Omit the clause, substitute:

"120.211 The applicant:

   (a)  either:

        (i)    seeks to enter Australia to work in accordance with a labour
               agreement; and

        (ii)   has qualifications and experience that are suitable for the
               position to be taken by the applicant under the labour
               agreement; and

        (iii)  unless exceptional circumstances apply, has not turned 55; or

   (b)  seeks to enter Australia in accordance with an RHQ agreement.".
