76.1 Omit the regulation, substitute: Fee for assessment of a person's work
qualifications and experience

"5.40. (1) The fee payable on an application for assessment, for the purposes
of the Act, of a person's occupational qualifications or experience (or both)
is:

   (a)  in the case of an assessment by NOOSR - $300;

   (b)  in the case of an assessment by the Department of Industrial
        Relations:

        (i)    for a standard skills assessment - $280; and

        (ii)   for an optional priority skills assessment - $470.

"(2) The fee payable on an application for internal review of an assessment
described in paragraph (1) (b) is $280.

"(3) Subject to subregulation (4), if the review of an assessment is decided
in favour of the applicant by a review authority, the fee paid under
subregulation (2) is to be refunded.

"(4) A fee paid under subregulation (2) in respect of an application for
review is not to be refunded if the applicant provided evidence for the
purposes of the review that was not provided for the purposes of the
application for assessment.".
