(1) The convenor of a meeting must give written notice of the meeting to:
- (a)
- for a meeting mentioned in paragraph 11 (1) (a) - as many of the
creditors of the fund as is reasonably practicable; and
- (b)
- for a meeting mentioned in paragraph 11 (1) (b) - as many of the
creditors and members of the registered organization as is reasonably
practicable; and
- (c)
- for a meeting mentioned in paragraph 11 (1) (c) - as many of the
members of the committee of inspection or creditors of the fund or registered
organization, as the case may be, as is reasonably practicable.
(2) The notice must be given to a person:
- (a)
- by delivering it personally;
or
- (b)
- by sending it by prepaid post to the person's last known address; or
- (c)
- if the person has a facsimile transmission number to which notices may be
sent to the person by faxing it to the person at that number; or
- (d)
- if the person has a document exchange number to which notices may be sent
to the person by lodging it with the exchange at, or for delivery
to, the person's receiving facilities identified by that number.
(3) The notice must be given not less than 14 days before the day of the
meeting, except when:
- (a)
- it is a meeting of creditors convened by the
administrator of the registered organization or fund, as the case may be; and
- (b)
- the administrator thinks it appropriate to give less notice.
- (4)
- The notice must be in accordance with Form 1 in Part 1 of Schedule 4.
- (5)
- Written notice of the meeting must also be given to the Council at least 7
days before the meeting.
