1994 No. 440 NATIVE TITLE (PRESCRIBED BODIES CORPORATE) REGULATIONS - REG 3

Kinds of prescribed bodies corporate
3. (1) An Aboriginal association is prescribed for the purposes of paragraph
59 (a) of the Act if it is incorporated under the Aboriginal Councils and 
Associations Act 1976 :

   (a)  after the commencement of these Regulations; and

   (b)  for the purpose of being the subject of a determination under section
        56 or 57 of the Act.

(2) An Aboriginal association is taken to be incorporated for the purpose of
being the subject of a determination under section 56 or 57 of the Act only
if:

   (a)  all of its members are persons proposed to be included in a
        determination of native title as the native title holders; and

   (b)  the purpose of becoming a registered native title body corporate is
        set out in the objects or in the Rules; and

   (c)  provision is made in the Rules for the performance of its functions as
        a registered native title body corporate, including provision in
        relation to consultation and consent in accordance with regulation 5.
