1991 No. 370 PUBLIC SERVICE (PARLIAMENTARY OFFICERS) REGULATIONS - REG 16

Election not to receive payment for overtime
16. (1) This regulation applies to an officer:

   (a)  whose normal hours of duty in a week are:

        (i)    42 hours in a sitting week and 32.5 hours in any other week; or

        (ii)   40 hours in a sitting week and 34.5 hours in any other week;
               and

   (b)  who is required, under regulation 65 of the Public Service
        Regulations, to perform public duty after usual duty; and

   (c)  who elects, in writing, not to be paid for the duty.

(2) For the purposes of paragraph 68 (4) (b) of the Act:

   (a)  the performance of the duty by the officer in the year is a special
        circumstance; and

   (b)  the additional period of recreation leave is the period of duty
        performed by the officer.

(3) The officer may make an election under subregulation (1):

   (a)  no later than 2 weeks after the day on which this regulation
        commences; or

   (b)  if the officer commences duty as an officer after the day on which
        this regulation commences-no later than 2 weeks after the day on which
        he or she commences duty.

(4) In any year after the year in which:

   (a)  this regulation commences; or

   (b)  the officer commences duty as an officer; he or she must make an
        election as soon as practicable, but no later than the end of 2 weeks
        after the day on which he or she commences duty in the year.
