1986 No. 132 PUBLIC SERVICE REGULATIONS (AMENDMENT) - REG 2

2. After regulation 70C of the Public Service Regulations the following
regulation is inserted: Application of provisions of section 22B to officers
of the Australian Security Intelligence Organization

"70D. (1) For the purposes of sub-section 22B (14) of the Act, the provisions
of section 22B of the Act apply, subject to sub-section (2), to and in
relation to the employment of persons employed as officers of the Australian
Security Intelligence Organization.

"(2) In the application, in accordance with sub-regulation (1), of section 22b
of the Act-

   (a)  a reference to a Department, to the Department or to Departments shall
        be read as a reference to the Australian Security Intelligence
        Organization;

   (b)  the definition of 'employment matters' in sub-section (1) shall have
        effect as if sub-paragraph (b) (ii) were omitted;

   (c)  references to employees shall be omitted;

   (d)  in paragraph (b) of the definition of 'equal employment opportunity
        program' in sub-section (1), 'and in the Service generally' shall be
        omitted;

   (e)  'relevant staff organizations in relation to officers in the
        Department' (wherever occurring) shall be omitted and 'the staff
        association referred to in Determination No. 4 of 1985 made under
        section 86 of the
        Australian Security Intelligence Organization Act 1979' substituted;

   (f)  the references in sub-section (3) to the commencement of section 22b
        of the Act shall be read as references to the commencement of this
        regulation; and

   (g)  a reference to the Secretary, to the relevant Secretary or to
        Secretaries shall be read as a reference to the Director-General of
        Security holding office under the
        Australian Security Intelligence Organization Act  1979 .".
