SCHEDULE 2 Subregulation 3 (3)
APPLIED OSS REGULATIONS
PART 1-UNMODIFIED PROVISIONS Subregulations 3 (2), (3), (4), (5), (6), (7),
(8), (9) and (10) Regulations 3B, 3C, 3D Part II, except regulations 18R and
18Y Regulations 23Q and 26 To the extent that they are applicable to other
provisions of the applied OSS Regulations: Schedules 1, 1A, 2, 3, 4, 5, 6, 7,
8 and 9
PART 2-MODIFIED PROVISIONS Column 1 Column 2 Applied Provision Modification
Subregulation 3 (1): Omit the definition of "the Act", substitute:
"'the Act' means the Occupational Superannuation
Standards Act 1987 as modified by the SIS (TP)
Regulations (being the applied OSS Act, within the
meaning of those Regulations);" Subregulation 3 (1): Omit "within the meaning
of section 5" from the
definition of "superannuation fund conditions",
substitute "referred to in section 12" Subregulation 3 (1): Insert the
following definitions:
"'SIS (TP) Regulations' means the Superannuation
Industry (Supervision) (Transitional Provisions)
Regulations;
'the unmodified Regulations' means the
Occupational Superannuation Standards Regulations
as in force from time to time;
'these Regulations' means the Occupational
Superannuation Standards Regulations as modified
by the SIS (TP) Regulations (being the applied OSS
Regulations, within the meaning of those Regulations);" Regulation 4: Omit the
regulation, substitute:
Instruments to apply for the purposes of the
modified Regulations
"4. For the purposes of these Regulations :
(a) a prospectus registered, or taken to be
registered, under regulation 5AAA, of
the unmodified Regulations; or
(b) an instrument made under a provision of
the unmodified Regulations;
(whether registered or taken to be registered, or
made, before or after the date of commencement of
the SIS (TP) Regulations) is taken, where applicable, to be:
(c) registered, or taken to be registered, for
the purposes of these Regulations; or
(d) made for the purposes of the corresponding provision
of these Regulations;
as the case requires."
