1994 No. 57 SUPERANNUATION INDUSTRY (SUPERVISION) REGULATIONS - REG 11.08

Eligible rollover funds
11.08. (1) For the purposes of subsections 31 (1) and 32 (1) of the Act the
requirements of subregulations (2), (5) and (6) are standards applicable to
all eligible rollover funds.

(2) Subject to subregulation (4), the trustee of an eligible rollover fund
must give to the Commissioner, within 28 days of the end of each half-year of
the fund, in relation to each member in respect of whom amounts have been paid
into or out of the fund during the half-year, a statement setting out the
following information:

   (a)  the member's name, date of birth, contact details and sex;

   (b)  if the member has quoted, or is taken under subsection 249 (5) of the
        Act to have quoted, his or her tax file number to the fund-that
        number;

   (c)  the fund's name, contact details and fund number;

   (d)  the name and contact details of the member's employer;

   (e)  the name, contact details and fund number of the fund that is the
        transferor fund in relation to the member;

   (f)  the amounts that the fund has received or paid out in the half-year in
        relation to the member;

   (g)  if the Commissioner requests in writing from the fund, in the
        half-year, information that the Commissioner reasonably believes may
        assist the Commissioner in administering the eligible rollover
        benefits register-that information;

   (h)  any other information that the trustee and the Commissioner agree, in
        the half-year, should be given by the fund to the Commissioner.

(3) In subregulation (2):

"contact details" means:

   (a)  in relation to the member-details of the person's residential address,
        postal address (if different) and, where available, telephone number
        and facsimile (electronic transmission) number; and

   (b)  in relation to the fund or the member's employer-the postal address
        and, where available, telephone number and facsimile (electronic
        transmission) number;

"fund number", in relation to a regulated superannuation fund or approved
deposit fund, means the number given to the fund by the Commissioner.

(4) A trustee need not give information of a kind referred to in subregulation
(2) other than the most recent information (if any) of that kind that is in
its possession.

(5) If the governing rules of an eligible rollover fund are amended, the
trustee of the fund must give a copy of the amendments to the Commissioner as
soon as possible after the amendments are made.

(6) If the Commissioner requests in writing a copy of the governing rules of
an eligible rollover fund, the trustee of the fund must give a copy of the
governing rules to the Commissioner as soon as possible after receiving the
request.

(7) Unless the contrary intention appears, expressions used in this regulation
that are defined for the purposes of Part 10 have the same meanings
respectively as in that Part.
