1994 No. 57 SUPERANNUATION INDUSTRY (SUPERVISION) REGULATIONS - REG 2.64

Information concerning notice of non-compliance
2.64. If the trustee of a PST receives a notice of non-compliance, the trustee
must give to each unit-holder:

   (a)  a statement of the circumstances (including details of the
        non-compliance) that gave rise to the issue of the notice; and

   (b)  a statement of the effect on the PST of the issue of the notice
        (including details of the effect on the PST's taxation position); and

   (c)  details of action that the trustee has taken, or proposes to take, to
        have the PST become a PST for the purposes of Division 2 of Part 5 of
        the Act; and

   (d)  any information concerning the non-compliance that the Commissioner
        requires to be given for the purposes of this paragraph. (NOTE: For
        the purposes of this regulation, a notice of non-compliance is a
        notice issued under section 40 of the Act stating that the entity is
        not a PST.)
