Crimes Regulations (Amendment)

Section 91 of the Crimes Act 1914 (the Act) provides that the Governor-General may make regulations for the purposes of the Act.

The Regulations identify organisations which provide legal assistance to Aboriginal persons and Torres Strait Islanders for the purpose of the definition of "Aboriginal legal aid organisation" in subsection 23B(1) of the Act.

Under Section 23B(1) of the Act "Aboriginal legal aid organisation" means "an organisation that provides legal assistance to Aboriginal persons and Torres Strait Islanders, being an organisation identified in the regulations for the purposes of this definition".

The Regulations prescribe the names of organisations which are to be Aboriginal legal aid organisations. The identification of these organisations is necessary to enable certain statutory obligations placed on investigating officials and the Minister by Sections 23H and 23J of the Act to be fulfilled.

Details of the Regulations are as follows:

Regulation 1 is a formal provision providing that the Crimes Regulations are amended as set out in the proposed regulations.

Regulation 2 inserts a new regulation 6A into the Crimes Regulations which provides that for the purposes of subsection 23B(1) of the Act an organisation specified in Schedule 3A to the Crimes Regulations is identified as an Aboriginal legal aid organisation.

Regulation 3 inserts a new Schedule 3A in the Crimes Regulations which prescribes the names of organisations which are identified as Aboriginal legal aid organisations for the purposes of subsection 23B(1) of the Act.
