EXPLANATORY STATEMENT

STATUTORY RULES 2002 No. 113

Financial Management and Accountability Act 1997

Financial Management and Accountability Amendment Regulations 2002 (No. 2)

Subsection 65(1) of the Financial Management and Accountability Act 1997 (the Act) provides that the Governor-General may make regulations prescribing matters required or permitted by the Act to be prescribed, or necessary or convenient to be prescribed for carrying out or giving effect to the Act.

The Regulations:

•       amend the prescribed agency of the Australian Federal Police (AFP) to include the staff of the Australian Protective Service and references to the Australian Federal Police Act 1979 (Schedule 2, Items [1] and [5]).

•       create three new prescribed agencies for the purposes of paragraph (c) of the definition of "Agency" in section 5 of the Act. The agencies would be:

-       "CrimTrac Agency", which was established on 14 June 2000 as an Executive Agency for the purposes of the Public Service Act 1999. As a prescribed agency under the Act it will become separate from the Attorney-General's Department for the purposes of the Act (Schedule 2, Items [2] and [4]).

-       "CSS Board", which is a statutory body created by the Superannuation Act 1976. As a prescribed agency, the Act will apply to its management of public money, such as administration expenses (Schedule 2, Item [3]).

-       "PSS Board", which is a statutory body created by the Superannuation Act 1990. As a prescribed agency, the Act will apply to its management of public money, such as administration expenses (Schedule 2, Item [3]).

•       change the description of the AGSO such that it will be called Geoscience Australia, reflecting the change in name that occurred on 12 April 2002 (Schedule 1, Items [1] and [2]).

Schedule 1 of the Regulations commences on gazettal (to reflect the name of Geoscience Australia) and Schedule 2 (amending the AFP and creating the CrimTrac Agency, CSS Board and PSS Board as prescribed agencies) commences on 1 July 2002, as the start of a financial reporting period.
