Federal Magistrates Court (Delegation to Registrars) Repeal Rules 2003
Section 81 of the Federal Magistrates Act 1999 (the Act) provides that the Federal Magistrates, or a majority of them, may make Rules of Court providing for or in relation to the practice and procedure to be followed in the Federal Magistrates Court.
Subsection 81(3) of the Act provides that Rules of Court are disallowable instruments for the purposes of section 46A of the Acts Interpretation Act 1901.
Rule 1 - Name of Rules
This rule provides that the Rules are the Federal Magistrates Court (Delegation to Registrars) Repeal Rules 2003.
Rule 2 - Commencement
This rule provides that the Rules commence on 3 November 2003, the same day as the day on which the Federal Magistrates Court Amendment Rules 2003 (No. 1) commence.
Rule 3 - Federal Magistrates Court (Delegation to Registrars) Rules 2000 -- repeal
This rule repeals the Federal Magistrates Court (Delegation to Registrars) Rules 2000 (Statutory Rule 2000 No. 171).
It is considered useful to have all the rules in relation to Registrars relocated into the Federal Magistrates Court Rules 2001.
