Productivity Commission Regulations 1998
Section 60 of the Productivity Commission Act 1998 (the Act) provides that the Governor-General may make regulations prescribing matters required or permitted by the Act to. be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to the Act.
Subsection 45(1) of the Act provides that the Chairman of the Productivity Commission (the Commission) may engage persons who have suitable qualifications and experience as consultants to the Commission. Subsection 45(4) of the Act provides that, where the estimated value of a consultancy exceeds the amount prescribed by the regulations, the Chairman of the Commission must ensure that an open and competitive tendering process is used to select the consultant.
The purpose of the regulations is to prescribe the amount of $20,000 for the purposes of subsection 45(4) of the Act.
The regulations commence upon gazettal.
