Primary Industries Levies and Charges Collection (National Residue Survey - Game Animals) Regulations
Section 8 of the National Residue Survey (Game Animals) Levy Act 1992 (the Act) provides that the Governor-General may make regulations, prescribing matters required or permitted by the Act to be prescribed, or necessary or convenient to be prescribed for the purposes of carrying out or giving effect to the Act.
Section 30 of the Primary Industries Levies and Charges Collection Act 1991 (the Collection Act) provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing all matters required or permitted by the Act to be prescribed, or necessary or convenient to be prescribed for the purposes of carrying out or giving effect to the Collection Act, in particular the making of provisions in relation to the payment of levy or amounts on account of levy and other amounts payable to the Commonwealth.
The purpose of the proposed regulations is to provide the appropriate administrative measures and set the operative levy rates under which the Primary Industries Levies and Charges Collection (National Residue Survey Game Animals) Regulations will operate from 1 July 1993.
The prescribed operative rate of levy appearing in section 6 of the Act in respect of game pigs is being reduced from twenty (20) cents per carcase to twelve (12) cents per carcase. The prescribed operative rate of levy appearing in section 6 of the Act in respect of game goats is being increased from eight (8) cents per carcase to nineteen (19) cents per carcase. The prescribed operative rate of levy appearing in section 6 of the Act in respect of kangaroos is being increased from eight (8) cents per carcase to forty (40) cents per carcase.
These rates of levy are effective from 1 July 1993 and are consistent with the wishes of the game industry in accordance with its commitment to the National Residue Survey under full cost recovery and the requirements of market access for game products into export markets.
The prescribed operative rate of levy appearing in section 6 of the Act in respect of other game animals is being set at zero, with effect from 1 July 1993, as no other game animals are subject to an NRS Levy at this time.
