Primary Industries (Excise) Levies Act 1999

Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3)

Section 8 of the Primary Industries (Excise) Levies Act 1999 (the Excise Act), provides that the Governor-General may make regulations prescribing matters required or permitted by that Act to be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to that Act.

Sub clause 14 (2) of Schedule 27 to the Excise Act provides that if there is a body designated in relation to a particular product, and before the Governor-General makes regulations, the Minister must take into consideration any relevant recommendation made to the Minister by the designated industry body.

The regulations implement a compulsory levy on certain products to fund industries' cost sharing obligations under the Emergency Animal disease Response Agreement for the chicken meat and egg industries. The Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3) will set an operative rate of levy. Collection arrangements will be identical to those for existing levies.

The establishment of government/industry cost sharing arrangements for emergency animal disease outbreaks is jointly supported by the Commonwealth government, State and Territory governments and industry. The money raised by a levy will be used to repay respective livestock industry debts to the Commonwealth government following those industries' request for the Commonwealth to underwrite their share of costs.

The Office of Regulation Review has been consulted and has advised that a Regulation Impact Statement is not necessary for the legislation (RIS ID number 5721).

Details of the regulations, namely, the Excise regulations, are contained in the Attachment.

The regulations commence on 1 July 2004.

ATTACHMENT

DETAILS OF THE PROPOSED PRIMARY INDUSTRIES (EXCISE) LEVIES AMENDMENT REGULATIONS 2004 (No. 3).

Regulation 1 would provide for the name of the proposed Regulations to be the Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3).

Regulation 2 would provide for the proposed Regulations to commence on 1 July 2004.

Regulation 3 would provide that Schedule 1 amends the Primary Industries (Excise) Levies Regulations 1999.

SCHEDULE 1       AMENDMENTS

Item 1 would insert a new operative rate for EADR levy for eggs at 1.5 cents per laying chicken.

Item 2 would insert a new operative rate for EADR levy for chicken meat at 0.033 cents per meat chicken.
