Proceeds of Crime Regulations (Amendment)
Section 104 of the Proceeds of Crime Act 1987 (the Act) provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing matters required or permitted by the Act to be prescribed, or necessary or convenient to be prescribed for carrying out or giving effect to the Act.
The Proceeds of Crime Regulations (Amendment) will extend the category of prescribed law enforcement agencies, eligible to apply for funding for law enforcement projects from. the Confiscated Assets Trust Fund, in accordance with a recommendation of the Report of the Review of the Confiscated Assets Trust Fund. The category of prescribed agencies will be extended to include the other three members of the body known as the Heads of Operational Commonwealth Law Enforcement Agencies (HOCOLEA), namely, the Attorney-General's Department, the Department of Immigration and Ethnic Affairs and the Insurance and Superannuation Commission.
Regulation 1 of the amending regulations is a procedural clause.
Regulation 2 amends regulation 16 of the Proceeds of Crime Regulations by including the Attorney-General's Department, the Department of Immigration and Ethnic Affairs, avid the Office of the Insurance and Superannuation Commissioner within the category of prescribed agencies listed for the purposes of subsection 34D(3) of the Act.
